Marriage in Peru is governed by the Civil Code and administered through the local civil registry offices and municipal authorities. Both civil and, optionally, religious ceremonies may be recognised, but only civil marriage produces legal effects under Peruvian law.
Eligibility Requirements
To marry in Peru, both parties must:
- Be at least 18 years old (or meet legal exceptions with judicial authorisation);
- Have legal capacity to marry (i.e., not currently married to another person); and
- Provide valid identification.
For the foreign spouse, additional requirements apply to prove identity, civil status, and legal capacity.
Required Documentation
For the Peruvian Spouse:
- National ID;
- Certified birth certificate;
- Certificate of single status (if required by the municipality).
For the Foreign Spouse:
- Valid passport;
- Birth certificate (apostilled or legalised, and translated into Spanish if necessary);
- Certificate single status, issued by the relevant authority in the home country; and
- Proof of legal entry into Peru (e.g., entry stamp or immigration record).
All foreign documents must typically be apostilled or legalised through a Peruvian consulate, and officially translated into Spanish by a certified translator in Peru.
Application Process
- Filing the Marriage Application: The couple submits their application and documents to the municipality where the marriage will take place. Each municipality in Peru may have slightly different procedural requirements, so local verification is advisable.
- Publication of Marriage Notice: A public notice is posted for a specified period (usually 8 days) to allow for any legal objections.
- Interview or Review: Some municipalities may require a brief interview or document verification process to confirm the authenticity and eligibility of both parties.
- Civil Ceremony: Once approved, the civil marriage ceremony is scheduled and conducted by a municipal official.
- Marriage Registration: After the ceremony, the marriage is officially recorded with the local civil registry office, and a marriage certificate is issued.
The process typically takes 2-4 weeks, depending on document readiness and municipal procedures. Delays are common if documents are incomplete or improperly legalised.
